2. Who Can Use Our Services

Our Services are intended for individuals 18 years of age or older. This is because our nutrition recommendations are designed for adults and are based, in part, on European Food Safety Authority (EFSA) nutrient reference values for individuals aged 18+, supplemented by proprietary logic and expert guidelines.

By creating an account, you confirm you are at least 18 years old. We do not knowingly collect data from individuals under 18, and such accounts will be deleted.

3. Territory Restrictions

Our Services are available to residents of the European Union and the United States. Access from other regions may be restricted or limited.

4. Accounts

To use the App, you must create an account using your email address and a secure password. You are responsible for maintaining the confidentiality of your account details and for all activity under your account.

We may suspend or terminate your account if you:

• Provide false or misleading information
• Attempt to hack, exploit, or disrupt the Services
• Upload harmful, illegal, or offensive content
• Harass other users or our staff
• Violate these Terms

5. Services Description

• Landing Page: Marketing information about Cholify and the option to join a waitlist for early beta access.
• App: AI-powered nutrition scoring, meal tracking, and personalized recommendations based on your input data (e.g., biometrics, dietary preferences, activity levels).

Important: Our Services provide general wellness and nutritional information only. They are not medical advice and should not replace consultation with a qualified healthcare professional.

6. Beta Access & Payments

6.1 Beta Access

Joining our beta is free, requires no credit card, and provides up to one month of premium access. After the beta, continued use may require a subscription.

6.2 Subscriptions

When subscriptions launch, we will offer monthly and yearly plans. Prices and details will be displayed in the App and on our website.

6.3 Refund Policy

We may offer refunds in the following cases:

• Technical issues that prevent you from using the paid features and cannot be resolved within a reasonable time
• Accidental duplicate charges

Refund requests must be submitted within 14 days of purchase.

7. User Content

You may upload or enter content, including:

• Meal data
• Photos (e.g., of meals)
• Notes (e.g., cooking instructions)

You retain ownership of your content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it for the purpose of providing and improving our Services.

We may use anonymized and aggregated data for research, analytics, and product improvement.

9. Health Disclaimer

Our Services are intended for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. 10. Intellectual Property

All intellectual property in the Services, including software, text, graphics, logos, and designs, is owned by Cholify s.r.o. or our licensors. You may not copy, distribute, or modify our materials without our written permission.

11. Limitation of Liability

The Services are provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we disclaim all liability for any indirect, incidental, or consequential damages arising from your use of the Services.

12. Termination

You may close your account at any time in the App settings. We may suspend or terminate your account if you breach these Terms or engage in prohibited conduct.

13. Changes to the Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via email or through the App. Continued use of the Services after changes take effect means you accept the new Terms.

14. Governing Law & Disputes

14.1 EU Users

For users residing in the European Union, these Terms are governed by Czech law. Any disputes will be resolved by the courts of Prague, Czech Republic, unless otherwise required by applicable consumer protection laws.

14.2 U.S. Users

For users residing in the United States, these Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable consumer protection laws.
