2. Who Can Use Our Services

Our Services are intended for individuals 18 years of age or older. This is because our nutrition-related features are designed for adults and are based, in part, on European Food Safety Authority (EFSA) nutrient reference values for individuals aged 18 and above, supplemented by proprietary logic and expert guidelines.

By creating an account, you confirm that you are at least 18 years old. We do not knowingly collect data from individuals under 18, and such accounts will be deleted if identified.

3. Territory Restrictions

Our Services are available to residents of the European Union and the United States. Access from other regions may be limited or unsupported, and certain features may not be available in all jurisdictions.

4. Accounts

To use the App, you must create an account using your email address and a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

We may suspend or terminate your account if you:

• Provide false or misleading information
• Attempt to hack, exploit, or disrupt the Services
• Upload harmful, illegal, or offensive content
• Harass other users or our staff
• Violate these Terms

5. Services Description

Landing Page

The Landing Page provides marketing information about Cholify and the option to join a waitlist for early beta access.

App

The App provides AI-assisted nutrition scoring, meal tracking, and personalized insights based on information you choose to provide (such as biometric data, dietary preferences, and activity levels).

Important: The Services provide general wellness and nutritional information only. They are not medical advice and should not replace consultation with a qualified healthcare professional.

AI-Generated Content

Certain features of the Services use artificial intelligence to generate estimates, insights, and recommendations. AI-generated outputs may be incomplete, inaccurate, or based on limited information. You acknowledge that AI-generated content is provided for general informational purposes only and should not be relied upon as factual, medical, or professional advice.

6. Beta Access & Payments

6.1 Beta Access

Joining our beta is free, requires no credit card, and provides up to one month of premium access. After the beta period ends, continued use of certain features may require a paid subscription.

6.2 Subscriptions

Prices and details will be displayed in the App and on our website. Subscriptions may automatically renew unless canceled through your Apple App Store account settings.

6.3 Refund Policy

Refunds may be offered in the following cases:

• Technical issues that prevent access to paid features and cannot be resolved within a reasonable time
• Accidental duplicate charges

Refund requests must be submitted within 14 days of purchase and are subject to the policies of the applicable app store.

7. User Content

You may upload or enter content, including:

• Meal data
• Photos (e.g., of meals or recipes)
• Notes or comments

You retain ownership of your content. By submitting content, you grant Cholify a non-exclusive, worldwide, royalty-free license to use, store, process, and display it solely for the purpose of operating and improving the Services.

We may use anonymized and aggregated data for analytics, research, and product improvement.

8. Privacy

We collect and process personal data to provide the Services. For detailed information about our data practices, your rights, and how we protect your information, please review our Privacy Policy, which forms an integral part of these Terms.

9. Health & Nutrition Disclaimer

The Services are intended for informational and wellness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified healthcare provider before making dietary, fitness, or lifestyle changes.

Nutrition Scores

Any nutrition scores or similar metrics displayed in the Services are estimates intended to help users understand how their dietary intake aligns with general reference values. These scores do not assess health status, diagnose conditions, or predict health outcomes.

9.1 FDA Disclaimer (U.S. Users)

These statements have not been evaluated by the U.S. Food and Drug Administration. The Services are not intended to diagnose, treat, cure, or prevent any disease.

10. Intellectual Property

All intellectual property in the Services, including software, text, graphics, logos, and designs, is owned by Cholify s.r.o. or its licensors. You may not copy, distribute, modify, or create derivative works from the Services without our prior written permission.

11. Limitation of Liability

The Services are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Cholify disclaims all liability for any indirect, incidental, special, or consequential damages arising from or related to your use of the Services.

12. Indemnification

You agree to indemnify and hold harmless Cholify s.r.o., its directors, officers, employees, and partners from any claims, damages, losses, liabilities, or expenses arising from:

• Your misuse of the Services
• Your violation of these Terms
• Your violation of any applicable law or third-party rights

13. Termination

You may close your account at any time through the App settings. We may suspend or terminate your access to the Services if you breach these Terms or engage in prohibited conduct.

14. Changes to the Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via email or through the App. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law & Disputes

15.1 EU Users

For users residing in the European Union, these Terms are governed by Czech law. Any disputes will be resolved by the courts of Prague, Czech Republic, unless otherwise required by applicable consumer protection laws.

15.2 U.S. Users

For users residing in the United States, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable consumer protection laws.
